In accordance with the Turkish Personal Data Protection Law No. 6698 ("KVKK"), your personal data is processed by HKM Hidrolik Kırıcı İş Makinaları ve Metal Sanayi Ürünleri Ticaret Ltd. Şti. ("HKM" / the "Company") as the data controller, within the scope described below.

2. Personal Data Processed

The following personal data is processed through the dealer/partner application form and the contact form:

  • Identity data: Name and surname of the authorised/contact person
  • Contact data: E-mail, phone/WhatsApp, address, country, city, website
  • Company-related data (to the extent it can be associated with the applicant as a natural person): company name, company type, activity/customer profile, brands represented, stock/workshop capacity, team and service information
  • Transaction security data: technical data related to the form submission

3. Purposes of Processing

  • Receiving and evaluating your dealership/partnership application
  • Contacting the applicant and providing information
  • Conducting pre-contractual negotiations and, where deemed appropriate, establishing the business relationship/contract
  • Managing requests and complaints
  • Fulfilling legal obligations and providing information to authorised institutions

4. Legal Grounds for Processing

Your personal data is processed on the following legal grounds under Article 5 of the KVKK:

  • Processing being directly related to the conclusion or performance of a contract (Art. 5/2-c)
  • Processing being necessary for the legitimate interests of the data controller (Art. 5/2-f) — evaluation and management of the dealer network
  • Your explicit consent (Art. 5/1) — in particular for the processing and transfer of data through service providers located abroad

5. Method of Collection

Your personal data is collected by electronic means, through automated and semi-automated methods, when you complete and submit the dealer application form or the contact form on our website (hkm.com.tr).

6. Transfer of Personal Data (Domestic and International)

The data you submit through the form may be processed and transferred via a service provider located abroad (Web3Forms), from which we receive form delivery infrastructure services, and via e-mail service providers whose servers may be located abroad, so that your application can reach us. This transfer is carried out based on your explicit consent under Article 9 of the KVKK.

In addition, your personal data may be transferred to authorised public institutions upon request, within the framework of fulfilling legal obligations.

7. Retention Period

Your personal data is retained for as long as necessary for the purposes for which it is processed and, in any case, limited to the statute-of-limitation periods set out in the relevant legislation. If your application is unsuccessful, your data will be deleted, destroyed or anonymised within 2 (two) years at the latest.

8. Your Rights as a Data Subject

Under Article 11 of the KVKK, you have the following rights:

  • To learn whether your personal data is being processed and, if so, to request information thereon
  • To learn the purpose of processing and whether it is used in accordance with that purpose
  • To know the third parties to whom data is transferred domestically or abroad
  • To request rectification if processed incompletely or inaccurately
  • To request erasure or destruction within the framework of Article 7 of the KVKK
  • To request that rectification/erasure operations be notified to third parties to whom the data was transferred
  • To object to a result against you arising from analysis solely by automated systems
  • To claim compensation if you suffer damage due to unlawful processing

9. How to Apply

You may submit your requests regarding your rights through the following means, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller:

  • By written application with a wet signature to the address above
  • To our registered e-mail address ([email protected]) via secure electronic signature or registered e-mail (KEP)
  • From your e-mail address registered in our system to [email protected]

Your applications will be concluded free of charge within 30 (thirty) days at the latest, depending on the nature of the request; if the process requires an additional cost, a fee may be charged according to the tariff determined by the Board.
